Use of this website is governed by these General Terms of Use, hereinafter referred to as the “Terms of Use.” By using the site, you acknowledge that you have read and accepted these terms. These terms may be modified at any time by the City of Nyon, which shall not be held liable in any way for any misuse of the service.

The City of Nyon places particular importance on data protection. The data collected is used solely for managing participation and communicating with users.

The data collected is managed with due care and protected against any form of misuse. Article 13 of the Federal Constitution, as well as data protection laws, guarantee everyone the right to privacy and protection against the misuse of personal data. The City of Nyon’s websites and online services comply with these provisions.

ARTICLE 1 - DEFINITIONS

For the purposes of interpreting these General Terms of Use of the Participanyon Platform, the terms used below, whether in the plural or singular, are defined as follows:

• Contributor: refers to any person who has created an “Account” through which they log in using a username and password that are strictly personal and confidential, and who participates on the Platform either to publish a proposal or to comment on a proposal accessible on the Platform.

• Contribution: refers to any proposal written by a Contributor that may be modified within thirty minutes.

• Participanyon Platform: refers to the City of Nyon’s digital participation platform, accessible to everyone, which brings together Proposals from Contributors and the Editor.

• Content: refers to any content published by a Contributor on the Platform, including any proposal or opinion on a proposal.

• Account: refers to a Contributor’s personal space on the website https://participanyon.ch/, which allows them to access specific content and contribute to the creation of Content on the Platform.

• Platform: refers to the digital tool, accessible to everyone via the website, through which Users can contribute via their “Account.”

• Visitor: refers to any person who has access to and/or uses the website without having opened an “Account” or used a service.

ARTICLE 2 - PURPOSE

The purpose of these Terms of Use is to define the terms and conditions for using the participatory platform offered by the Publisher and accessible to everyone.

The Editor has set up a participatory platform allowing Contributors to take part in participatory events and processes organized by the City of Nyon.

ARTICLE 3 – SCOPE OF APPLICATION

The Platform’s Terms of Use apply, without restriction or reservation, to all services offered on the Platform.

The Platform’s Terms of Use are supplementary, where applicable, to the specific terms and conditions applicable to certain services offered within the various sections of the Site.

The Platform’s Terms of Use take effect upon their publication on the Site and remain in force until they are partially or fully amended by the Publisher.

Platform users will be notified of changes via the platform. Continued use after a change constitutes acceptance of the new terms.”

ARTICLE 4 – CONTENT MODERATION

It is the responsibility of Contributors to ensure that their Content does not infringe on the rights and freedoms of others and complies with applicable regulations.

The Contributor hereby agrees that their Contributions on the Platform may be viewed by all Visitors to the Platform.

Content provided by Contributors is subject to post-publication moderation by the Publisher, who reserves the right to remove or delete any Content that does not comply with laws and regulations or with these Terms of Use.

Contributors and Visitors are invited to report any Content that violates the principles and values listed above to the Editor via the reporting links on the Site or by sending an email to participanyon.

ARTICLE 5 – LIMITATION OF LIABILITY OF THE PUBLISHER

The information contained on this site is as accurate as possible, and the site is updated periodically; however, it may contain inaccuracies, omissions, or gaps. If you notice an omission, error, or what appears to be a malfunction, please report it by email to participanyon.ch, describing the problem as precisely as possible (the page causing the issue, the action that triggered it, the type of computer and browser used, …).

Any content downloaded is done so at the user’s own risk and under their sole responsibility. Consequently, the City of Nyon cannot be held liable for any damage to the user’s computer or any loss of data resulting from the download.

The City of Nyon assumes no liability for hyperlinks provided on this website that lead to other resources on the Internet.

PROCESSING OF PERSONAL DATA

ARTICLE 6 – RIGHT OF ACCESS AND CONFIDENTIALITY

In accordance with personal data protection laws, users have the right to access, correct, modify, and delete data that pertains to them personally.

Most of these rights can be exercised through the Contributor’s Account (data retrieval form, information modification, and account deletion). For any other requests, these rights may be exercised:

• by mail to the City of Nyon

• or electronically at participanyon@nyon.ch

Users may exercise their rights in accordance with applicable law. In the event of a dispute, they may bring the matter before the competent civil courts, in particular on the basis of rules relating to the protection of privacy and data protection. They may also contact the Federal Data Protection and Information Commissioner (FDPIC) if they believe that the processing of their personal data does not comply with applicable legal provisions.

ARTICLE 7 – PROCESSING OF PERSONAL DATA

The information collected in connection with the creation and use of the Account, as well as the content published by the Contributor, is processed solely by the City of Nyon (with the exception of the service provider contracted by the City to manage the Platform) for purposes necessary to administer and moderate the event in which the Contributor is participating, as well as to compile anonymized statistics.

Information regarding the Contributor is not disclosed to third parties, with the exception of the service provider engaged by the City of Nyon to manage the Platform or to organize participatory processes (participation agents). These service providers are subject to strict confidentiality obligations and may not use said information for any purpose other than those prescribed by the City of Nyon.

Regarding the Participatory Budget, in accordance with the “Internal Directive on the Participatory Budget concerning the operation of the Participatory Budget” of the Municipality of Nyon, only residents whose primary residence is in the Municipality, regardless of age or nationality, may participate in voting on a Participatory Budget project. The collection of the additional data listed above is therefore necessary so that we can verify that you are indeed a resident of the Municipality; it will be used solely for this purpose. This data will not be linked to your user account and will be deleted as soon as the Participatory Budget round in which you participated ends. Furthermore, this data is not shared with third parties, with the exception of the service provider contracted to manage the platform and the identity verifiers. These parties are subject to strict confidentiality obligations and may not use the data for any purpose other than those prescribed by the City of Nyon.

The provisions regarding the processing of personal data described above also apply to individuals visiting the platform without creating an account, to the extent that data concerning them may be collected through cookies or similar technologies, particularly for technical, security, and statistical purposes. This data is processed in accordance with the purposes and principles set forth above

Personal data collected through this participatory platform is retained for as long as necessary to fulfill the purposes for which it was processed. In accordance with applicable legal provisions, this data is subsequently deleted or anonymized as soon as it is no longer necessary for those purposes.

ARTICLE 8 – USE AND CONFIGURATION OF COOKIES

The Platform uses cookies that are necessary for its operation, as well as for measuring traffic and improving its performance. The data collected in this context is aggregated and anonymized. Users can disable cookies by selecting the appropriate settings in their browser. However, doing so may prevent the use of certain features of the Platform.
